Dear Mr Woodruff

Following our recent residents meeting held at the Onyx offices in Waldo Road there were several actions agreed to be completed by Onyx and the Environment agency.

One of the actions they took was to respond to the list of questions we presented them in written form centering around the issues and inconsistencies of the various licences that have been granted to Onyx. We asked for a written response by 30th November, as yet we have heard nothing from either party. Whilst I appreciate that you do not have any power over the Environment Agency, I would imagine that you have some over the actions of Onyx on a Council owned site.

All the questions and actions can be found at a new website that has been created to communicate the outcome of the residents meeting as well as general information about the site. It can be found at www.waldoroadtip.co.uk. We shall be doing all we can to promote this site to local residents so we can get feedback ready for the next meeting in February, including getting it published in local papers, but please feel free to add it as a link on www.bromley.gov.uk .

I'd be grateful for a prompt response as to why we have not had a response from Onyx regarding our questions and for you to push for a speedy response to the issues raised as I am sure you are well aware of them and would like a response too.

I note that the website has now been updated with a response from the EA. However, there are still several questions which need to be resolved, and as Tony suggests, these would sensibly make for a useful agenda at our next meeting.

I would also hope that some of the measures Onyx have taken will have begun to have an impact; this should allow us to consider whether they are sufficient, or what further steps need to be taken. Hopefully, this will maintain the constructive dialog we are all hoping becomes the norm.

Thank you for your reply. The website will be kept up to date with any correspondence relating to Waldo Road.

I agree the response from the EA leaves a lot to be desired of particular concern is the fact that they seem to add their own interpretations / wording on to some of the answers which are not written or agreed in any of the licences and as such aren't leagally valid answers. We shall be taking this point up with the EA.

Could you please detail the measures Onyx have taken as we have not seen any evidence of Onyx actioning their agreed action points as yet which is rather disheartening as this was the point of the meeting and they said that they would take these as they were small and easy to implement.

Can you please confirm if you are able to add this link onto Bromley Council's website?

The EA's response demonstrates the difficulties with the site licence, which was originally written to cover a site which was both a CA site and a major waste transfer station.

The nature of the EA's role is to ensure that the site is run within the guidelines of the licence, and their comments suggest that they are comfortable that this is the case. However, within those parameters, further steps can be taken to ensure that we limit the impact of the site on our neighbours, and this is what we hope to achieve through the meetings.

Whilst I appreciate that there are issues with the licence which are open to interpretation, it would seem practical to concentrate on those aspects which have an effect outside the site, to maximise the benefits of any actions.

I will speak with Onyx regarding progress on the action points agreed. However, please bear in mind that the Christmas/New Year period is extremely busy in terms of waste, with extra volumes, changes to collection days and weekend working (and tipping) for refuse and recycling collections, which ties up many of the normal management resources. As things return to normal (after this weekend), I would expect the action points to be addressed rapidly.
